ORGANISATION: The jobholder reports to the Head of Commercial & Contracts Light Transport, MRTT and Airbus Derivatives, related Services and Aerostructures (TMCAT), within the Military Aircraft Commercial & Contracts organisation (TMCA). The position requires the job holder to represent Airbus DS for the respective area of responsibility vis-a-vis the domestic Customer(s), External Companies, International Customers, Suppliers, Military, Governmental and NATO organizations.
SCOPE: Aircraft and Services sales proposals and contracts in relation to Light Transport Aircraft, MRTT and Airbus Derivatives, related Services and Aerostructures programmes plus, eventually, any other MAS current and future portfolio items such as Future Mid-size Tactical Cargo AC (FMTC), FCAS, EuroDrone, etc.
MISSION:
Develop and negotiate the commercial parts of the contractual documentation supporting sales during the different phases of the Sales process (including negotiation) in any financial/commercial and/or contractual/legal topics which might arise.
Support contract execution by managing commercial and contractual matters from signature until and including the delivery of the product/service.
Monitor the customer obligations throughout the sales contract life.
MAIN ACTIVITIES:
Prepare commercial proposals and contracts translating internal and external requirements into bids and ensuring compliance checks.
Lead the commercial contract negotiations with emphasis on contract terms and conditions supported by Finance, Legal, and other functions, compliant with internal and external rules and financial objectives.
Support contract execution enforcing the sales purchase agreements/contract including main milestone/related payments management and in close alignment & agreement with Finance, Legal, and other functions.
Ensure claim and waiver management: Monitor the customer obligations and associated changes along the contract life cycle. Negotiate remedial actions to ensure agreements and avoid disruptions.
SPECIFIC TASKS:
In Acquisition phase (before Contract Signature):
Contribute to the commercial proposal preparation process (OTOCOQ) and MG3/SR/RMC Infopacks.
Support MG01, MG02, and MG03 preparation and execution. Prepare and support MG04 execution.
Support M&S for the Capture Plan preparation and follow-up.
Provide commercial risk assessment and recommend respective contingencies to Finance.
Ensure adequate business case review prior to MG03.
Coordination and preparation of the Commercial Volumes of the proposal.
Deliver and present the offer to the Customer together with Sales.
Proposals storage and distribution, maintaining proposals database and standards.
Drafting T&Cs in coordination with Legal.
Negotiating T&Cs with Customers.
Coordinating/supervising opening of Guarantees, bonds, etc.
In Execution phase (after Contract signature):
Business Partner for all commercial matters to the Programme organisation during contract execution.
Commercial focal point with the Customer for contract execution (e.g. negotiation of LDs, retentions, withholdings, Commitment Letters / Delivery Agreement Letters, etc).
Supporting the PMO in the acceptance and delivery of the products/services.
Drafting T&Cs in coordination with Legal for contract amendments/change requests.
Negotiating T&Cs with Customers for amendments/change requests.
Contract closure in support of the PMO.
SKILLS: The Job holder is a key interface to all functions involved in the bid preparation and contract execution. It is in the nature of the job to be managing and moderating conflicting interests between functions in order to achieve a common solution for the respective bid/contract, therefore this job requires a high level of conflict management skills.
EDUCATION/EXPERIENCE:
Educated to degree level in Law, Business Administration or equivalent.
3-5 years experience in the Commercial/Procurement field.
Experience in drafting and negotiating contract terms and conditions.
Deep knowledge on the Airbus' Products and Services.
Experience in a multicultural environment, open-minded and used to cross-functional teams.
Versatility and Adaptation Capacity to accommodate changes and (re-)deployment based on business and organizational needs.
English and Spanish: Negotiation Level. Other languages knowledge will be considered as a plus.
Availability to travel.
